MEMORANDUM FOR THE RECORD
SUBJECT: Watergate Incident
1. Met with Mr. Henry E. Petersen, Assistant Attorney
General, Criminal Division, Department of Justice and Mr. Kevin
T. Maroney, Deputy Assistant Attorney General, Internal Security
DeDa:rtment of Justice. I exhibited to them two memoranda
from to Chief, Executive Staff dated 12 August 1971
and 9 September 1971. These are the two memoranda referred to in
the responses to various questions forwarded to Mr. Petersen by
memorandum of 21 December 1972. The specific question was, "Did
we have any other dealings with Liddy while he was in the Treasury
or the White House?" After reviewing these two memoranda, Mr.
Petersen stated he had no need for these and no copies were retained.
2. I delivered a copy of the indirect assessment of Ellsberg
dated 9 August 1971.
3. I delivered a package of now declassified documents which
were selected by Mr. Petersen and Mr. Maroriey at our meeting with
them on 4 May 1973. They have classified copies of these documents
which were forwarded by memorandum dated 21 December 1972 from
John S. Warner, Deputy General Counsel, and a memorandum to the
Attorney General from Mr. Helms dated 18 October 1972. Copies of
the exact documents given in unclassified form are attached. Mr. �
Petersen said he wished to study these more thoroughly and reflected
that possibly none of these would have to be put into court and possibly

they could be exhibited, if necessary, to the Judge in camera. I
indicated that such action might be helpful but that, if deemed
necessary, they could use all of the documents furnished them at
this meeting. Mr. Petersen promised to advise us of the action
to be taken.
4. Later I advised Mr. Petersen that under the circumstances
the Director did not wish to have George Carver testify in the Ellsberg
case. Mr. Petersen said he would inform David Nissen.
5. I also called to Mr. Petersen's attention the Seymour M.
Hersh article in today's NEW YORK TIMES wherein it states that
General Cushman was questioned by agents of the FBI late last week.
I asked Mr. Petersen if he could determine if in fact the FBI had
interrogated General Cushman. He promised to advise. I indicated
to Mr. Petersen that this was important since the Director will appear
before McClellan's committee on Wednesday of this week. As Mr.
Petersen well knows, nowhere is Ehrlichman's telephOne call to
General Cultaman documented by the Agency and Ehrlichman has
testified before the grand jury that he does not remember placing
the call.
6. Chief, Central Cover Staff, has been
advised about the documents. He indicated that in any event he does
not think he will permit Stephen Carter Greenwood to go to Germany.
I ventured the opinion there had been leaks from a number of places
and with the possibility of a special prosecutor being appointed, the
Department of Justice may not have full control of the documents.
