Dear Mr. Leopold:
This is a final response to your 1 August 2013 Freedom of Information Act (FOIA)
request for "all CIA records for the three month period of November 1, 2010 through
January 31, 2011 regarding communication the CIA had with the New York Times and/or
New York Times editor Bill Keller." As you will recall, in our 28 August 2013 letter, we
informed you that we had already begun processing a request for this information in
connection with an earlier FOIA request received prior to yours. We cross-referenced your
request to the earlier one in order to send you any records that were found to be releasable.
The earlier case was recently concluded. Enclosed are two documents, consisting
of two pages, that we determined were releasable in segregable form with deletions made
on the basis of FOIA exemptions (b)(3) and/or (b)(5). An explanation of exemptions is
also enclosed. Additional material was determined to be currently and properly classified
and must be withheld in its entirety on the basis of FOIA exemptions (b)(1) and (b)(3).
Exemption (b)(3) pertains to information exempt from disclosure by statute. The relevant
statutes are Section 6 of the Central Intelligence Agency Act of 1949, 50 U.S.C. � 403g, as
amended, and Section 102A(i)(1) of the National Security Act of 1947, as amended. As the
CIA Information and Privacy Coordinator, I am the CIA official responsible for this
determination. You have the right to appeal this response to the Agency Release Panel, in
my care, within 45 days from the date of this letter. Please include the basis of your
appeal.
