Marking 1. Attached is a memorandum for your signature to USI.B Principals concerning the extensive use of the ORCON control marking and requesting an early review of the current uses of ORCON. 2. At a meeting of community representatives on 5 November 1975, possible cources of action to ease the handling and dissemination problems in DIA caused by the extensive use of ORCON were discussed. It was agreed that a memorandum to the community urging strict compliance with the DCID would be a first step toward solving these problems. 3. The Security Committee will continue to explore other possible solutions to this and other problems experienced by the community as a, result of the DCID. We are currently proceeding along the following lines: (a) Consideration is being given to paragraph markings; (b) Examining the mechanics for clearing ORLON materials for release to named overseas corm-sanders; (c) Monitor. ing the use of. DCID 1./7, ORCON Control Marking 1. Since the implementation of DCID 1/7 on 5 October 1975, the use of the control marking "Dissemination and Extraction of Information Controlled by Originator (ORCON)" has been of special concern. Although the language of the DCID was carefully considered, the current wide use of ORCON was not anticipated. It was intended to be a very restrictive marking, though currently developing practices are causing handling and dissemination problems in the intelligence community. 2. 'I feel it is important for all USIB departments and agencies to make a. critical review of their current uses of ORLON. It is requested that this review be made at an early date to ensure that its use in future reports is in strict compliance with the DCID. I believe the judicious use of ORCON would resolve a major portion of the problems currently encountered and could avoid the requirement to amend the subject DCID.. 3. The USD3 Security Committee will monitor the use of. DISCUSSION: I have been in touch withi DDI OCI and and their comments are attached as Tab A and B, respectively. They have coordinated in draft on this response, as did Ray Haddock, State/INR/DDC. 25X It is my understanding that Gen. Faurer is responsible for the dispatch of this cable. His concern was prompted by complaints that DINCEDR and CINCNAVEUR are not getting the type of intelligence information they need because of the ORCON restrictions. Gen. Graham is also aware of this problem. I believe that their basic complaint is not with DCID 1/7 but with what they think is an. over-use of the ORCON marking by middle management. They would like to discourage its use on general distribution documents. The DDO probably would not agree with this. SECOM will. continue to monitor this problem and is reconvening the working group which drafted the DCID. Hopefully, through this mechanism and the one suggested in the cable, a solution to this problem can be reached. RECOMMENDED ACTION: That you sign the attached cable to DIA. We are reviewing your most recent proposal regard- ing the new ORCON control. We have already taken several steps to alleviate some of the problems mentioned by DIA in connection with the new ORCON control. 2. At the meeting with DIA representatives 25X1 on 12 October, we suggested that DIA use the sanitize version of the NIB to meet some of its distribution require- ments. As we mentioned at the meeting, we prepare a daily NIB cable for our own overseas recipients and USIB community customers, including DIA. This NIB cable version has all ORCON material deleted from it, and is sent nightly to SSO DIA, at a Sigint NOFORN classification. 3. At DIA's request, we also worked out an arrangement with DIA whereby OCI authorizes DIA to disseminate the OCI Weekly Review controlled ORCON to the current DIA list of recipients. (See attached memo from OCI dated 24 October 1975.) 4. We are willing to work out with DIA an agreement for the NIB, as soon as DIA provides the current full dis- semination list. 5. We agree with DIA that these publications should be given full dissemination to those with a real need-to-know. They nevertheless do contain much sensitive intelligence, and there is also a risk of too wide dissemination, particularly overseas.
